Comment on Notice of Proposed Rulemaking (NPRM) Gutting Access to Work Permits

DHS has issued a proposed regulation that would gut access to work permits for asylum seekers by:
Barring acceptance of new EAD applications until USCIS can process asylum applications within 180 days—a timeline USCIS itself admits may take up to 173 years to achieve

Setting waiting period to apply for an initial EAD (once applications resume) to 365 rather than 150 days from filing

Removing the 30-day processing requirement

Barring EADs for people who entered without inspection or failed to apply within one-year of entry or have a criminal bar—all as determined by the EAD adjudicator rather than in asylum interviews/adjudications

Mandating biometrics

Allowing prioritization of asylum adjudication based on negative info discovered in the EAD application

Making asylum EADs discretionary

Comment on Interim Final Regulation Severely Restricting BIA Appeals
EOIR has issued an interim final rule (IFR), that will become effective March 9 (litigation is pending), which will make changes that severely restrict appeals to the BIA by:

Reducing the timeline to file from 30 to 10 days

Making the default a summary dismissal unless the Board unanimously votes to take-up the appeal

Comments are accepted until April 8.
