Case summary:
ES, a Nicaraguan university student and activist, became politically active after her former boyfriend, a member of the university student organization CUUN, was found murdered with his body mutilated and burned. While the government blamed members of the student organization, many believed the killing was carried out by state actors. Seeking justice, ES participated in protests, including the broader April 18 anti-government demonstrations. Because of her activism, she became a target of government authorities.
Police and pro-government actors began surveilling ES at her home, university, and in public spaces. She received repeated death threats and threats of violence through social media from accounts displaying pro-government symbols, and on one occasion she was physically assaulted in the street. Due to the escalating threats, ES went into hiding with her family in a safe house for three months, though police continued to monitor her home by frequently parking outside. In 2021, ES began a relationship with a fellow activist, and once authorities learned of their relationship, threats extended to him as well.
The harassment and surveillance persisted through 2023 and 2024, prompting them to flee Nicaragua together and seek safety in the United States.
Theory of the Case: Fear of future persecution by state and non-state actors based on political opinion and membership in a particular social group, including family.
