E was born in Honduras and grew up with his mother as his only caretaker. He never knew his father. His mother's boyfriend, who lived with E throughout his childhood, frequently beat him and his mother. E was also the victim of sexual abuse, and his mother either did not know or was unable to stop the abuse. When E was 14, his mother had to take care of an ailing family member in a different city. He started living alone thereafter, and his mother stopped providing his basic needs. He had to drop out of school in 2020, and began working at a farm to provide for himself. While E was 17, he was providing for both himself and his mother. His mother was unable to work, since she had become very ill and suffered from extremely high blood pressure. The economic situation in Honduras made it impossible for him to find work that could provide for them both, so he decided to cross the border into the US while still being underage to help his mother.
Theory of the case: SIJS based on abuse, abandonment, or neglect by both parents. Once SIJS is approved court proceedings can be terminated. Asylum application has been filed at the Asylum Office, claim can stay open while child awaits ability to apply for green card.
Commitment: Asylum - supplement asylum application, attend interview (if applicable); SIJS – complete and review predicate order, file SIJS application; Removal – terminate court proceedings
